Terms and Conditions
General
Booking a Villa is completely different from booking a hotel room. The duration of the booking, payments and cancelations, security etc. are all different, so please do not just tick the box to accept these terms and conditions without reading the following conditions carefully.
Whenever you, “the Guest” make a reservation and book a Mykonos Art or an Actor’s Villa “MAV” or “Mykonos Art Villas”, a) A rental contract is created between “the Guest” in whose name the booking is made and of course on behalf of all members of his party, and Mykonos Art Villas, “the owner” for the agreed period named “Rental Period” b. You accept the detailed terms & conditions that follow:
Payments
When the Guest makes a booking request, the Guest must make the appropriate deposit payment to Mykonos Art Villas within 2 working days of availability confirmation. The following deposit payment must be received by Mykonos Art Villas.
-For rentals beginning more than 60 days after the date of the booking request – a deposit of 50% of the total rental amount is payable
-For rentals beginning 60 days or less after the date of the booking request – the total rental amount is payable as a deposit
-If the required deposit payment is not received within the 2 working day period, Mykonos Art Villas reserves the right to void the Guest’s booking request.
-Where a 50% deposit applies to the booking, the Guest must pay the remaining 50% balance not less than 60 days before the scheduled arrival date.
All payments must be made in Euros and must be made in accordance with Mykonos Art Villas’ payment instructions as set out in the Guest’s booking confirmation.
If payments are not made on or before the due dates as required herein, Mykonos Art Villas may cancel the booking, in which case this Rental Contract will be thereby terminated without any further notice required. Cancellation charges may apply as detailed below.
It also has to be made clear that Mykonos Art Villas can be booked directly thru various on-line booking sites, so we do not accept any responsibility or liability for possible online bookings of the property during the above-mentioned period of the 2 working days.
Additional costs
The cost of the Wi-Fi internet, satellite TV, electricity, water, draining, cleaning, pool and garden maintenance and local taxes are included in rental rates. There are generally no additional costs, surcharges, taxes, staff salaries, or management fees above the price quoted except for those described in the relevant chapter “Extra services upon request (extra costs apply)” of the property description, or unless otherwise stated the Guest booking confirmation voucher. Gratuities for household staff are not necessary.
Booking confirmation Voucher
Confirmation details, the Property location (map, address, etc.), contact details of the “Owner” or Owner’s Representative, possible transfer arrangements and directions to the Property will be sent to the Guest in a booking confirmation voucher when full payment is received. This voucher, along with the Guest’s ID card, need to be presented upon arrival.
Arrival & Departure times
Mykonos Art Villas are flexible in the departure and arrival times. We always try to accommodate the Guest’s actual arrival and departure times, subject to availability. Typical check-out and check-in times are 12:00 noon and 4:00pm respectively, unless stated otherwise.
Security Deposit
Mykonos Art Villas will require a security deposit of 10% of the total cost of the stay, with a minimum of one thousand (1,000) Euros for the Art Villa and eight hundred (800) euros for the Art Villa 2. The respective amount for the Actor’s Villa 3 bedrooms is 600 euros and for the Actor’s Villa 2 bedrooms, 400 euros. Those amounts may be payable directly to Mykonos Art Villas or to our Representative or to the reservation platform, immediately upon arrival at the Villa at the latest. Access to the Villa may be refused if security deposit is not paid in full.
When the security deposit is required to be paid in cash, or when a non-standard security deposit applies (weddings, parties etc.), Mykonos Art Villas will inform the Guest in advance of the amount payable and any other conditions.
The security deposit will be refunded at the end of the rental period, after deducting the cost of replacement or repair for any loss or damage to the Villa or its surrounds or contents caused during the Rental Period. If this cost cannot be reasonably determined prior to the Guest’s departure, Mykonos Art Villas or our Representative is entitled to withhold a reasonable estimate from the Guest’s security deposit, and will return any balance to the Guest as soon as possible after the actual cost has been determined.
Damage or Losses in the Villas
Mykonos Art Villas are someone’s homes. Therefore, the Guest must treat them accordingly and leave the Properties and all their contents in good order and in an acceptably clean condition.
Any damage or losses caused during the Rental Period, as well as any special cleaning requirements will be the Guest’s responsibility and may be charged to the Guest’s account and deducted from the Guest’s security deposit. In cases of excessive or unacceptable loss or damage at any time during the Rental Period, the Owner or Owner’s Representative may require the Guest and their party, including visitors to vacate the Property immediately, without compensation or refund.
Access
Mykonos Art Villa and its facilities are available for the Guest’s full enjoyment during the Rental Period. However, the Owner, Owner’s Representative, or other staff and contractors may need access to the Property from time to time (e.g. for maintenance purposes to the house, garden, swimming pool, utilities and services, or for the purposes of providing additional services requested by the Guest, etc.). The Guest is required to give them reasonable access to the Property for these purposes.
Number of Guests
The number of persons (adults and children) staying at Mykonos Art Villas must not exceed the maximum number of sleeping places indicated in the booking confirmation and reservation voucher, unless specifically authorized in writing. Exceeding this number may cause safety problems. Entry or access to the Property may be refused or limited where the number of guests exceeds the stated requirement.
Use of Property and premises
All bookings to Mykonos Art Villas are assumed to be for normal holiday purposes only, and the Guest agrees that the use of the Property will be limited to this purpose unless otherwise confirmed in writing. Neither the House nor any part of the House or yard, swimming pool etc., shall be used at any time during the term of this rental for the purpose of carrying on any business, profession, or trade of any kind, or for any purpose other than as a private single-family residence.
If the Guest is planning to hold an event, such as a wedding or party, which involves having a larger number of people at the Property, or if the Guest is planning to use the Property for a purpose other than holiday, please communicate this to Mykonos Art Villas at the time of booking, as special approval or arrangements will be required. Depending on the nature of the event, a surcharge and/or additional security deposit will be required, which will be agreed and confirmed in writing prior to confirming the reservation. Note that Mykonos Art Villas are in residential areas, and therefore, they are subject to rules and regulations regarding their use. Note that all the events must be held within the Quite Hours of Greece.
Assignment and Subletting
A: Tenant or Guest shall not assign this lease or rental or sublet or grant any concession or license to use the House or any part of the House without Owner's prior written consent.
B: Any assignment, subletting, concession, or license without the prior written consent of Owner, or an assignment or subletting by operation of law, shall be void and, at Owner's option, terminate this Lease or rental.
Noise & Disruption
Mykonos Art Villas are located in residential areas. The Guest is asked to respect this, and ensure that all guests and visitors to the villa behave appropriately. It is especially very important that residents take the responsibility to follow the Quiet Hours of the country which are the following:
Summertime 1 Apr-30 Sept: 15:00-17:30 & 23:00-07:00
Wintertime 1 Oct-31 Mar: 15:30-17:30 & 22:00-07:30
In no case will Mykonos Art Villas or the Owner’s Representative individually or collectively be liable to any problems concerning noise & disruption, with the police or the neighbors of the Villa.
Conduct and Due Care
Mykonos Art & Actor’s Vilas’ residents and their guests are expected to comply with the rules and regulations set by the Greek Government. Illegal or immoral activities including gambling, prostitution, prohibited drugs, possession or use of pyrotechnics or dangerous goods, and possession or use of firearms and other weapons are all strictly prohibited. Smoking is prohibited inside the villa.
The Guest is responsible for the behavior of the guests staying at the Villa, as well as visitors to the Villa during the Rental Period. Should any guests or visitors not behave in a suitable manner, Mykonos Art Villas or our Representative may, in their absolute discretion, require the Guest, their party and/or visitors to leave the premises and/or vacate the Villa immediately, without compensation or refund
In the interests of safety, due care should be taken at the Property at all times, especially with children. Suitable supervision should be given around pools, beaches and roads, and when using all Property’s facilities.
Price Fluctuation
Mykonos Art villas states that, if the Guest’s booking is confirmed, the price of the Guest’s reservation is fully guaranteed, even if some changes to the price of the property rental occur. In return for this commitment, no refunds will be made for any exchange rate fluctuations that would otherwise reduce the rental cost.
Mykonos Art Villas reserves the right to impose any taxes or other charges which may be implemented by the government or other regulatory body, which were unknown at the time of publishing. Mykonos Art Villas will tell the Guest promptly in the unlikely event that it becomes aware that any taxes or charges will apply to the Guest’s booking.
Cancellations
If the Guest wishes to cancel a confirmed booking, written notice of cancellation must be sent to Mykonos Art Villas. All cancellation notices received by Mykonos Art Villas will be acknowledged in writing. It is strongly recommended that the Guest and all members of the Guest’s party purchase trip cancellation insurance.
Cancellation of a booking includes but is not limited to: a) Cancellation of one or more days of a booking. b) An amendment of a booking so that none of the dates of the booking once amended fall within the same dates that originally constituted the booking c) Failure of all Guests to provide the required documentation on arrival (eg. Passports or suitable identification) and d) Attempt by the Guest, their party or visitors to hold an event at the Property in breach of these Terms and Conditions or breach of any rules applicable to the Mykonos Art & Actor’s Villas.
In the event that the Guest cancels a confirmed booking, the following cancellation fees will generally apply:
A. Advanced payment
If the cancellation is made 48 hours or more after the reservation, any advanced payment, already made to Mykonos Art & Actor’s Villas and is up to 50% of the total rental amount, will be forfeited.
B. Other payments, additional to the advanced payment
-0% of the remaining rental amount will be forfeited if the cancellation is made more than 120 days before the start of the rental period
-50% of the remaining rental amount will be forfeited if the cancellation is made between 120 and 60 days before the start of the rental period
-100% of the remaining rental amount will be forfeited if the cancellation is made between 1 and 60 days before the start of the rental period.
The applicable amount will be deducted from the deposit and moneys paid, and Mykonos Art Villas will refund any remaining balance to the Guest.
Please note that in case a Villa is reserved through a reservation platform, the cancelation policy stated in the respective platform prevails and the guests are expected to comply with the rules and regulations set by that platform.
Amendments
There are no fees applied for amendments made by the Guest after the booking confirmation is issued. Mykonos Art Villas will do its best to accommodate any reasonable amendments, but the Guest should be aware that some changes may not be possible.
In any case no refund is possible if it is in conflict with the cancelation policies described above.
Complaints
Mykonos Art & Actor’s Villas will make every attempt for the Guest to have an enjoyable stay. If the Guest should have a problem during the Rental Period, he should inform immediately Mykonos Art & Actor’s Villas or our Representative, who will try to solve any problems and put things right. In order for the Guest’s complaint to be addressed, the Guest must communicate any problem whilst on location and specifically within 1 hour from the time the above-mentioned problem arose. If no complaint is reported during the Rental Period, Mykonos, within the time frame set above, Art & Actor’s Villas will assume that the Property was to the Guest’s satisfaction and no complaint will be entertained.
Provisions
Mykonos Art Villas are self-catering accommodations and as such they require that the Guest supply all provisions and consumables necessary for daily living. Mykonos Art Villas may accommodate any reasonable requests to purchase provisions on the Guest’s behalf, and this will be charged to the Guest’s account.
Mykonos Art & Actor’s Villas’ Responsibility
The descriptions, assessments and ratings of Mykonos Art Villas that are published or given to the Guest are provided in good faith and in the belief that they are accurate based on the latest information of the villa. However, Mykonos Art & Actor’s Villas cannot be held responsible for any modifications or inaccuracies to the Villas, especially in its contents (carpets, plates, glasses etc.). Where Mykonos Art Villas publishes or refers to descriptions, assessments and ratings of the Villas either by Mykonos Art Villas or by third parties, these ratings are for information purposes only and Mykonos Art Villas will not be held responsible for any reliance placed on these ratings.
Disclaimers
Mykonos Art Villas do not accept any responsibility or liability for
- Any physical injury, sickness, death, loss, damage, inconvenience or additional expenses incurred by the Guest, their party or visitors regardless of the cause.
-Any vehicle or the contents of any vehicle used, hired or engaged by the Guest or their party during the Rental Period.
- Inability of the Guest or any member of the Guest’s party to enter the location of the Property or stay at the Property for all or part of the Rental Period as a result of failure to obtain appropriate travel or visa documentation, cancellation or amendments to travel arrangements or the missing of flights or travel connections.
-Any delay or cancellation of the booking as a result of war, threat of war, riot or civil strife, strike, demonstration, terrorist activity (threatened or actual), natural disaster, fire, sickness, weather conditions, action at an airport or port by any government or public authority, technical problems relating to transport and airport regulations caused by technical, mechanical or electrical breakdowns, or any technical, structural, electrical, plumbing or other problems or difficulties with the Property which make it unsafe or unusable, or any other circumstances which amount to ‘force majeure’, or other events beyond the Owner’s control.
In no case will Mykonos Art Villas or our Representative individually or collectively be liable to make any payment or give any refund or compensation of any amount over and above the total rental amount paid.
Jurisdiction
This agreement will be governed by the laws of Greece only. In the event of controversy arising from the booking, both parties agree to try to solve any difference amicably.
By making its booking request, the Guest agrees that these terms and conditions have been read, understood and have been accepted and agreed to by the Guest without reservation and without exception.
Facilities for Infants
Mykonos Art villas will contain at least one or two baby cots. If you require more facilities, please advise us at time of booking. A small charge to supply additional facilities may apply.
Babysitting
Mykonos Art Villas has the policy not to recommend babysitting. But since sometimes babysitting is a fundamental requirement for many of our clients, we help them by simply providing a list of babysitting providers in the area of the villa. However, it is important that it is recognized that we have not carried out any evaluation of the staff in the list, we do not recommend any babysitting provider and therefore we accept no liability for the use of any babysitting provider on any list we may provide.
Valuables and Security
Any Guest valuables or property left or used at Mykonos Art Villas are at the Guest’s own risk. Neither Mykonos Art & Actor’s Villas, nor any of our representatives accept any responsibility for loss of or damage to Guest property. The Guest is responsible for the Property during the Rental Period, and must ensure that all windows, shutters and doors are locked securely when not in the premises. And the alarm systems are activated. Any act or omission by the Guest, their party and/or visitors which may negate or prejudice the Property’s insurance policy and/or results in loss or damage is the Guest’s responsibility.
Safety & Protection
The safety standards and regulations are those of Greece. As a result, please be careful when in unfamiliar buildings or surroundings, and get to know the escape route from Mykonos Art Villas in case of fire. Mykonos Art Villas may include "hazards" such as open staircases, unfenced areas, mezzanines, open drops etc, and it is imperative that your party take responsibility for their own safety.
As with all rental properties in prime locations there may be a small risk of burglary, so please take advantage of our alarm systems and safes and take every precaution against theft and burglary, especially do not leave any doors shutters or windows open. Any valuables left at the property are left at your own risk. Neither Mykonos Art Villas nor our agents or representatives can take responsibility for any loss or damage.
Dangerous materials
Guests shall not keep or have in or around the House any article or thing of a dangerous, inflammable, or explosive character that might unreasonably increase the danger of fire in or around the House or that might be considered hazardous.
Swimming pools
Mykonos Art & Actor’s Villas have swimming pools, which are not manned. The swimming pools have no safety features such as pool alarms, covers and fences. Please familiarize yourself thoroughly with the depth of the pool and how to get out, and exercise safety and caution at all times, especially with children, non-swimmers and if diving. Children and non-swimmers are your responsibility at all times. The swimming pool is usually available from March to mid-November.
Water
The water in Mykonos is clean, but not potable due to the fact that almost all quantities are produced by desalination. Neither Mykonos Art & Actor’s Villas nor our agents or representatives can take responsibility for the quality of the water produced by the desalination factory and distributed by car tanks.
Animals (Pets or other)
Guests shall keep no domestic or other animals in or about the House without the prior written consent of Owner. Also, it must be made clear that Mykonos Art & Actor’s Villas are located outside of the Town, in the countryside, amongst other Villas. Therefore, a neighbor’s pet (cat or dog) may enter from the fences into the outdoor areas of the Villas. Neither Mykonos Art & Actor’s Villas nor our agents or representatives can take responsibility for any pets appearing at the outdoor areas of the Villas.
Bugs and insects
Mykonos Art & Actor’s Villas are located outside of the Town, in the countryside. Therefore, it is natural to have various bugs and insects like for example mosquitos, ants or myriapods around. The guests need to take precautious measures, such us using anti-mosquito devices (which are available for their use in every room at no cost) as well as keep doors, balcony doors and windows shut. Neither Mykonos Art & Actor’s Villas nor our agents or representatives can take responsibility for any bugs or insects entering the Villas.
Access to St Nickolas’s Church (Art Villa only)
All guests will have access to St Nickolas’s Church, but it will not be open and available at all times. You should contact the management for details and permits
Weather
Mykonos Art & Actor’s Villas cannot be held accountable for adverse weather conditions or the consequences of adverse weather. No refunds will apply in the cases of no sunshine or other adverse weather conditions
